Supreme Court: Premature to interfere in judges' appointment bill

NEW DELHI: The Supreme Court on Monday dismissed challenges to the National Judicial Appointment Commission, saying the bill is yet to receive Presidential assent and become a law of the land.

The SC also dismissed petitions challenging the National Judicial Appointment Commission (NJAC) Bill, which envisages to change present system of appointments to higher judiciary through the CJI headed collegium system.

The apex court refused to entertain Fali Nariman's argument to refer the question whether a bill violating basic structure of the Constitution could be challenged in a 5-judge constitution bench.

The SC accepted attorney general Mukul Rohatagi's argument that the constitutional amendment bill is yet to be sent to states for ratification after which the President's assent would come into picture. So, the challenge is premature, Rohatagi said.
