HC relief for Uddhav Thackeray

MUMBAI: The Bombay high court on Thursday rejected a plea made by Jaidev Thacekeay to restrain brother Uddhav from dealing with the estate left behind by late Shiv Sena chief Bal Thackeray, their father.

The set back to Jaidev and relief for Uddhav came on an application made by Bal Thackeray's estranged son who has been left with nothing in the father's will.


The HC rejected his plea as ''non-maintainable'' after agreeing with the oppositon raised by Uddhav's lawyers from Kanga & Co. The HC on Wednesday had reserved for orders the dispute that arose among the Thackeray siblings.


Jaidev sought orders from the court to restrain Uddhav Thackeray from alienating any of the properties in including the landmark Matushree bungalow in Bandra east which mostly went to Uddhav who took over the reins to the party as well.


Jaidev's lawyer Seema Sarnaik argued at length in court while Shailesh Vaidya the solicitor for Uddhav essentially told the court that the brother has no right to raise this issue at this stage.


Uddhav and four other executors named by Thackeray in his December 13, 2011 will, moved the HC to get the will certified as valid by the court last January. But soon, Jaidev, who got estranged from his father years ago, filed a 90-page affidavit to deny and rebut the validity of the will. The matter turned into a contest last June. The family estate left behind by Thackeray including the properties and bank deposits were worth Rs 14.85 crore according to the will. The real value is far higher, is Jaidev's contention.


Jaidev's contention was that Uddhav must be restrained to do anything till disposal of the suit.But on technical grounds the court declined to pass any such orders.
