"I can't simply adjourn. It is a specially-assigned case and the proceedings have to go on a day-to-day basis. It is you who have brought this order and you should have been conscious of this," Justice C R Kumaraswamy reminded Jayalalithaa's counsel on the first day of the hearing, after the latter requested adjournment to January 12 to enable them to get the services of a senior counsel.
In the evening, Jayalalithaa's counsel sought adjournment of hearing till January 8, which was again rejected by the judge, who said he is bound by the Apex Court order directing hearing on a day-to-day basis.
The judge then adjourned the proceedings to Tuesday after Jayalalithaa's counsel read out the FIR and the annexures.
Earlier, BJP leader Subramanian Swamy requested permission to address arguments since he is the original complainant in the case. He said he has been recognized as a necessary party in the bail order passed by the Apex Court in December and also in the written submission by Jayalaithaa.
When the court asked him if he was agreeable to assisting special public prosecutor G Bhavani Singh in terms of section 301(2) of the Criminal Procedure Code, Swamy declined, saying that as per the SC judgment in the JK Tyres International case, he, as the original complainant, can assist the court independently.
DMK leader K Anbazhagan, on whose application the trial was transferred to Bengaluru, sought permission to assist the court as an intervener, as done in the trial court.
To this, the judge asked him if an order passed by a trial court was binding on the high court. Turning to the special public prosecutor, the judge asked whether he is the prosecutor or these two - Anbazhagan and Subramanian Swamy. Bhavani Singh replied saying interveners have no role to play in the matter now.
