Supreme Court verdict on undertrials: MP officials point such prisoners are regularly released on bail

BHOPAL: Supreme Court, on Friday, may have ordered release of all undertrials who served half of their maximum sentence, but Madhya Pradesh jumped the gun long before the verdict by regularly releasing prisoners on bail.

Prison authorities claimed there is not a single undertrial in any jail in state, who spent half the maximum sentence in jail. Officials pointed that Madhya Pradesh is the only state in country where jail department has its own legal cell. It looks after issues due to which there is no pendency of such cases.


Deputy inspector general (prisons) R S Vijayvargiya told TOI "There is no undertrail in MP jails as we strictly comply with the procedure under Section 436A of Criminal Procedure Code."


As per criminal procedure code, cases of such prisoners are put up in court where they are bound to be released on bail, the official said.


On Thursday, an apex court bench headed by Chief Justice R M Lodha said, "Judicial officers shall identify prisoners who completed half the maximum period of imprisonment provided for offences they are charged with. After complying with procedure under Section 436A of Criminal Procedure Code, they will pass appropriate orders in jails for release of such prisoners."


There are 11 central jails, 78 sub-jails, 32 district jails and one open jail in Madhya Pradesh, which houses around 33,000 criminals. However, the total capacity of jails in MP is around 25,000, which means that it is overcrowded by 8000 prisoners.
