A division bench headed by Chief Justice DH Waghela while declining to review the earlier order on the issue,noted that though the BBMP passed a resolution in 2005 to accommodate the petitioners at Ejipura EWS quarters, ID cards given by the civic body and ration cards do not confer any right on the petitioners as they are unauthorized occupants and are tenants of original allottees having no allotment letters.
However, the bench observed that the petitioners do have a right to shelter and noted that BBMP and the government have already decided to build residential complexes and allot them free of cost at Sulikunte village, near Varthur, on a five-acre plot. Noting there may be teething problems vis-a-vis rehabilitation, the bench asked the petitioners to approach the state government and BBMP to set up a grievance redressal cell at Sulikunte. The state government was also asked to consider setting up schools, colleges and hospital at Sulikunte to benefit the petitioners.
