The state government chargesheeted Khemka for 'misconduct' and damaging the reputation of UPA chairperson Sonia Gandhi's son-in-law Robert Vadra by canceling the mutation of his land deal with realty giant DLF. However, the government has not taken any action against two other IAS officers—Anil Kumar and S C Goyal—who were held responsible by the HC for 'illegal transfer' of plots to land developers.
The two officers were predecessors of Khemka in the land consolidation and holdings department and were slammed by the HC for passing several orders 'without jurisdiction' during their tenure as director, consolidation. Khemka was transferred from the consolidation department after he cancelled the Vadra-DLF land deal mutation in October, 2012.
After the intervention of the HC, an FIR was registered against Goyal on June 9, 2011. Goyal, who is posted as secretary, Haryana Human Rights Commission, is facing arrest in the case and is on leave these days, while Anil Kumar is posted as home secretary in Chandigarh. But, the state government has not started any administrative actions against them.
Khemka had also sent a letter to the chief secretary in September 2012, requesting that the transfer of land by his predecessors Goyal and Anil should be probed by an independent agency.
Goyal was held responsible by HC for passing an illegal order when in January 2008 he had allowed the exchange of around 120 kanal 'shamlat deh' (panchayat common land) at Sehsola village in Mewat district with a plot owned by his relative Medha Gupta against the rules and beyond his jurisdiction.
In February 28, 2011, the HC had held that Anil Kumar in total abuse of powers and authority vested by law had allowed exchange of land that belonged to the gram panchayat in Gurgaon district.
Last year, the HC had described the acts of these two officers as 'fraud'. Court had also quashed all the orders passed by these officers in transferring the village common land to the developers.
