2G case: Lawyers ask 120 questions to Dayalu Ammal, magistrate records her statement

CHENNAI: Chief metropolitan magistrate (CMM) M Gopal on Monday recorded the deposition of DMK chief M Karunanidhi's wife Dayalu Ammal, who is a prosecution witness in the 2G spectrum case.

The deposition of Dayalu Ammal went on for nearly four hours at her residence in Gopalapuram here. Sources told TOI that CBI's lawyer Sushil Kumar asked about 80 questions to Dayalu Ammal while lawyers of accused Karim Morani and Shahid Balwa posed 20 questions each.


"Evidence has been recorded and it will go to court. She gave answers acceptable to the court," Sushil Kumar told mediapersons when asked if she had given any lucid answers.


Dayalu Ammal, 84, is suffering from Alzheimer's disease and has been undergoing treatment for more than a year. Her elder daughter Selvi Selvam and counsel assisted her during the deposition.


The CMM arrived 9.50am and proceedings started at 10am. Karunanidhi's daughter and DMK MP Kanimozhi and Sharad Kumar, managing director of Kalaignar TV, were among the accused in the case who were present at the Gopalapuram residence.


CBI officials last week served summons to her in this regard. Gopal was appointed as commissioner by CBI special court judge OP Saini who is conducting the trial in Delhi.


On October 14, the special judge pulled up the Chennai CMM for delaying the recording of Dayalu Ammal's statement and observed that it might prolong the trial in the 2G case. The court said that despite lapse of over a month, the statement had not been recorded.


On August 22, the Supreme Court declined to exempt her from deposing as a witness in the case. However, the apex court had exempted her from personal appearance in the special CBI court and directed that she be examined in Chennai. The apex court had passed the order on a plea filed by Selvi seeking a direction to exempt her mother from appearing before the trial court on medical grounds.


The CBI had summoned all 17 accused in the 2G case for personal appearance during the deposition. But Delhi CBI court allowed the plea of 12 of the 17 accused seeking exemption from personal appearance on the ground that they didn't wish to cross examine Dayalu Ammal.
