SC says no appointment of judges till NJAC declared valid

NEW DELHI: The Supreme Court on Thursday told the Centre that no fresh appointment of Judges to SC and HC should be done by the NJAC till its validity was tested.

Attorney general Mukul Rohatgi requested the constitution bench not to pass any written order and said no appointment will be done by the NJAC without taking prior permission of SC during the pendency of petitions challenging the validity of the NJAC.

The AG also informed that two eminent members to NJAC would soon be chosen by the CJI, PM and leader of Congress party in Lok Sabha to make NJAC functional.

He also said the NJAC will clear the appointment if all additional judges in high courts whose term could end during the pendency of the petitions in SC.

The court will start hearing on validity of NJAC from Monday.
