The petition will come up for hearing on Monday.
After prolonged litigation, the EC had on July 13 issued a show-cause notice to Chavan, asking him why he should not be disqualified for violation of the Representation of the People Act. The EC had asked Chavan to submit his reply in 20 days from the date of the order.
Defeated candidate Madhav Kinhalkar and BJP leader Kirit Somaiya had lodged a complaint with the EC in November 2009, saying Chavan, who had won the 2009 assembly election, did not submit election expenses as required by the provisions of the Representation of the People Act.
While the EC took cognizance of Kinhalkar's complaint, Chavan had challenged the proceedings before the Delhi high court and subsequently before the Supreme Court, which asked the EC to issue a show-cause notice to Chavan before taking a final decision.
In its final order, the EC observed that Chavan failed to lodge his election expenses in the manner required under the provisions of the Representation of the People Act.
"The ECI issued show-cause notice, asking him why he should not be disqualified for his failure to lodge his election expenses," Kinhalkar said. "We don't know if Chavan has replied to the notice or not."
Earlier, before the ECI, Chavan had submitted that since has resigned as a member of the legislative assembly, the proceedings have become ineffectious, however his contention was not accepted.
Chavan was among the only two senior Congress leaders, who were elected to the Lok Sabha despite the Modi wave across the country. Chavan was expecting a key assignment for the ensuing assembly polls, but all will depend on the ongoing proceedings before the ECI and the high court.
