Samjhauta blast: Aseemand moves HC for release on bail

CHANDIGARH: An accused in Samjhauta blast case, Swami Aseemanand, on Tuesday moved an application before the Punjab and Haryana high court seeking his release on bail from the judicial custody.

In his application, Swami Aseemanand has argued that there is not an iota of evidence with the prosecution to establish there case against him.

Swami further submitted that he is in custody for the past four years and there are around 300 witnesses in this case, some of which are in Pakistan and it would take years to complete the examination of all the witnesses.

On November 30, 2013, the special NIA court had dismissed his bail plea after accepting the arguments of National Investigations Agency (NIA) that letting out Aseemanand on bail would be fatal for the prosecution. NIA had also argued that since some of the accused involved in the case are still at large, Aseemanand could tamper with the investigations.

Aseemanand's petition is expected to come up for hearing on Wednesday.

A total of 68 people were killed when bombs were set off on February 18, 2007 in two coaches of Samjhauta Express, a peace train running between Delhi and Lahore at Diwana near Panipat city of Haryana.

The initial probe into the bomb blast was conducted by the Government Railway Police (GRP) and special investigation team of Haryana Police. It was subsequently taken over by NIA on July 29, 2010 following a directive from the home ministry.

On January 24 this year, the special NIA court in Panchkula had framed charges against Aseemanand, Kamal Chauhan, Lokesh Sharma and Rajinder Chaudhary for planning and executing an act in which 68 persons have been killed and several others injured. The trial is pending before the special NIA court Panchkula.
